Terms and Conditions - Coaching Services

This agreement is between the purchaser of coaching services (“You”/”the Coachee”/”the client”) and Martin Cole trading as Self Determined Life (“the Coach”)

  1. Coaching is a collaborative, solution focused, results-oriented and systematic process, in which the Coach facilitates the enhancement of work performance, self-directed learning and/or personal and professional growth and change on the part of the Coachee/client.


  1. The Coach agrees to provide You with coaching services to facilitate your achievement of specific and agreed goals and/or personal or professional development needs (“Coaching”). Coaching is provided through one-off sessions or through a series of regular coaching conversations or meetings with You (‘Coaching Sessions’), or in accordance with the terms and conditions set out below.


  1. You agree to pay the Fees in accordance with payment arrangements provided for in this agreement.


  1. Unless otherwise agreed, fees are due at the time that you book a Coaching Session.


  1. Fees for Coaching Sessions:· £120 per one off session· £220 per calendar month for monthly sessions (“Fees”)


Coaching Sessions

  1. One-off Coaching Sessions are each of one hour duration. Monthly Coaching Sessions comprise 2 coaching sessions per calendar month, each of 1 hour duration.


  1. A Coaching Session may be carried out over the telephone, by video call or other online conferencing facilities, or in person at mutually agreed places and times.


  1. Coaching Sessions will take place at agree times or, for monthly sessions are agreed intervals for approximately 1 hour. You must be on time for all Coaching Sessions.


  1. You agree to provide a minimum of 24 hours’ notice to the Coach if you wish to cancel or alter the time of a Coaching Session otherwise You will be liable for the full Coaching Session fee in the absence of such notice.


Your Commitments

  1. Throughout the working relationship You agree that you will:


a. Demonstrate a willingness to be actively involved and committed to coaching;

b. Give permission to the Coach to challenge and confront thinking, behaviours and feelings during the Coaching sessions in support of development goals, recognising that such actions are appropriate even though they may cause you to feel unsettled, disturbed, upset or annoyed;

c. Agree with the Coach the interim activities to be carried out between Coaching Sessions and action these between sessions in order to obtain the full benefit from the Coaching;

d. Participate with an open mind and a readiness to change, progress and develop;e. Be prepared and on-time to all coaching sessions with interim activities completed.

f. Inform me promptly if you believe the Coaching is not working for you.

The Commitments of The Coach

  1. Throughout the working relationship the coach will:


a. Be full committed to engaging in the Coaching Sessions as jointly agreed between the parties;

b. Determine with You the most useful and desired outcomes of the Coaching services.

c. Apply contemporary and, as the case may be, personal, organisational and executive coaching practices within the Coaching relationship.

d. Provide a safe, yet challenging learning environment for You to promote exploration, discovery, development and change.

e. Take a holistic, integral approach to coaching to ensure, within the confines of those matters that the coach can influence, that You have the best opportunity to reach your desired outcomes.

f. Seek feedback from You and review coaching outcomes achieved against the goals set.

Your health and well-being and decisions

  1. You agree to disclose details of past or present psychological or psychiatric treatment if such issues become salient during the Coaching relationship. In such a situation, the Coach may recommend referral to an appropriate specialist.


  1. You understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment and will not use it in place of any form of diagnosis, treatment or therapy.


  1. You understand and agree that you are fully responsible for your physical, mental and emotional well-being during Coaching sessions. You are aware that you can choose to discontinue coaching at any time.


  1. You understand and agree that you are fully responsible for all choices and decisions you make during and after the period of Coaching.


  1. You understand and agree that coaching is not a substitute for professional advice by legal, medical, psychiatric, financial, business, spiritual or other qualified professionals. You agree that you will seek independent professional guidance for legal, medical, psychiatric, financial, business, spiritual or other matters. You understand that all decisions in these areas are exclusively yours and you acknowledge that your decisions and your actions regarding them are your sole responsibility.


Limitations

  1. Given the nature of coaching services, The Coach makes no representation or warranty to you that any of the Coaching methods or the Sessions will work for your particular circumstances or bring about your desired outcomes.


  1. In any event and without prejudice to Clause 17, the liability of the Coach for any breach of contract, duty or other legal obligation is limited to the total sum of fees paid under this agreement at the time of the alleged breach.


Ethics and Confidentiality

  1. Anything discussed or any issues raised during the course of coaching will be on a strictly confidential basis.


  1. The Coach may maintain file notes on the progress of the Coaching Sessions, and, where this occurs, will ensure complete confidentiality of this information, except where required to divulge information by law or as agreed by You for a specified purpose.


  1. The coach works within the professional ethics guidelines designated by the International Coaching Federation (ICF). Copies of the ethical guidelines are available on request.


  1. You agree that the Coach can to include your name, phone number and email address in his log of coaching hours for ICF credentialing. This information would be treated in strict confidence and no other information about your coaching would be revealed.


Termination of Agreement

  1. Either party may terminate this agreement by giving not less than 7 days written notice (email is sufficient for this purpose).


Procedure on Termination

  1. Upon termination in accordance with Clause 23, any unpaid fees in respect of completed coaching sessions become immediately due and owing by you to The Coach. Any fees already paid by you for coaching sessions that have not been completed will be refunded.


  1. Upon termination The Coach shall immediately cease to be liable to you in respect of the Coaching and the Coaching Sessions.
